User Agreement

Welcome to PlantCare: Identify & Diagnose (referred to as “the App” or “PlantCare”).
Please read this User Agreement (“Agreement”) carefully before using the App.
By downloading, installing, or using the App, you agree to be bound by this Agreement.
If you do not agree to these terms, please discontinue use immediately.
1. Parties to the Agreement
This Agreement is entered into between you (“User”) and the App developer (“we” or “us”).

2. Service Description
1. The App provides features including, but not limited to:
- Plant identification
- Preliminary disease detection and care suggestions
- Plant care history and records
- Plant management and reminders (if applicable)
2. Non-Professional Advice Disclaimer
- All identification results, plant information, and suggestions are for reference only.
- The App does not provide professional horticultural, agricultural, medical, or toxicology advice.
- Information such as disease assessment or plant toxicity may be incomplete or inaccurate.
- You are responsible for any decisions made based on the App’s results, including handling, consuming, or treating plants.
- In cases involving safety or high-risk situations, you should consult a qualified professional.
3. Permissions & User Content
- To use certain functions, you may need to grant access to your camera, photos, or upload plant images.
- You confirm that you own or have rights to all content you upload and that it does not infringe on any third-party rights.
- You grant us a lawful, revocable license to store, analyze, and process your uploaded content solely for providing and improving App services.
- We will not sell, rent, or share your identifiable personal information with unrelated third parties unless required by law.

4. User Obligations
You agree not to engage in activities including but not limited to:
- Uploading illegal, infringing, violent, discriminatory, or otherwise inappropriate content;
- Attempting to hack, disrupt, or reverse-engineer the App or its servers;
- Using automated scripts to scrape, copy, export, or manipulate App content;
- Sending spam, advertisements, or other unauthorized commercial messages;
- Any behavior that harms App operation, other users, or the developer.
Violation of these terms may result in warnings, restriction of features, or termination of access.
5. Intellectual Property
- All content in the App—including design, code, algorithms, UI elements, text, and media—is owned by us or licensed to us.
- You may not copy, distribute, modify, sell, or use such content without permission.
- You retain rights to your uploaded content but grant us a limited license as described above.
6. Third-Party Services
- The App may use third-party services such as cloud storage or analytics.
- These services are operated independently by their providers.
- We do not guarantee their availability, accuracy, or security.
- Use of such services is subject to their respective terms and policies.
7. Disclaimer & Limitation of Liability
- The App is provided “as is”, without warranties of any kind.
- We are not responsible for losses resulting from:
- Network failures, device issues, or force majeure events;
- Your misunderstanding or misuse of identification results;
- Failures of third-party services;
- Violations of this Agreement by the user.
To the extent permitted by law, our total liability shall not exceed the amount you paid for the App (if any; otherwise zero).
8. Modification and Termination
- We may update this Agreement as needed. Updated terms will be displayed in the App and take effect immediately.
- If you do not accept the updated terms, you must stop using the App.
- We may suspend or terminate services to users who violate this Agreement or applicable laws.
9. Governing Law and Dispute Resolution
Unless otherwise required by law, this Agreement is governed by the laws of the developer’s location.
Disputes shall first be resolved through friendly negotiation; failing that, either party may bring the dispute to a court of competent jurisdiction where the developer is located.
10. Subscriptions
You will be automatically charged the price displayed on the payment screen (or Apple Pay pop-up screen) for the subscription period you selected, unless you cancel at least 24 hours before the end of the free trial.
Your subscription will automatically renew at the end of each period (weekly, monthly, every 6 months, annually, or other specified duration) until you cancel.
Payment will be charged to your iTunes & App Store/Apple ID account at confirmation of purchase (by accepting the subscription terms on the Apple pop-up screen using Touch ID, Face ID, or other means) or immediately after the end of the free trial period.
When you start a subscription, the amount shown on the payment confirmation screen (or Apple Pay pop-up) will be charged to your Apple ID account.
If your subscription includes a free trial, you will not be charged until the trial period ends. Unless you cancel at least 24 hours before the end of the trial, the subscription will automatically renew at the selected price.
Subscriptions renew automatically at the end of each billing cycle (weekly, monthly, semi-annual, annual, or other specified duration) until canceled.
You may cancel your free trial or subscription at any time by managing your subscription settings in your Apple ID account.
Subscriptions can be managed directly through Apple. Deleting the app does not cancel an active subscription.
For purchases made via the Apple App Store, you will need to submit a refund request directly to Apple and follow the instructions on the Apple Customer Support page.
